The temporary residence permit based on employment is necessary for foreigners who plan to permanently reside in Ukraine
However, if you work in Ukraine, but your work is primarily remote, or you don’t need to stay on Ukrainian territory for more than 90 days within a 180-day period, you do not need the residence permit.
To obtain a temporary residence permit in Ukraine based on employment, you need to first obtain a work permit for foreigners and stateless persons.
After your employer has obtained the work permit for you, you need to go through three stages to obtain the temporary residence certificate in Ukraine:
- Obtain a work visa for Ukraine of type “D-04.”
- Submission and issuance of the temporary residence certificate in Ukraine.
- Registration of your place of residence in Ukraine.
Procedure for obtaining a temporary residence certificate based on employment
After a foreign worker has obtained the “D” visa and arrived in Ukraine, he/she can submit an application for a temporary residence certificate to the territorial unit of the State Migration Service of Ukraine (but no later than 15 working days before the expiration of the D visa).
Required documents:
- Foreign passport with a “D” type visa.
- Certified translation of the passport into Ukrainian with personal data and the “D” type visa.
- Valid medical insurance for the entire validity period of the certificate.
- Work permit for foreigners and stateless persons.
- Employment contract (in cases where a work permit is not required).
- Application from the employer requesting the issuance of the certificate for its employee and committing to inform the State Migration Service and the employment service in case of early termination of the employment contract.
- Payment of state fees.
Processing time: 15 working days.
Validity period: issued for the same period as the work permit (up to three years).
Procedure for registering the place of residence in Ukraine
After obtaining the temporary residence certificate, the next step is to register the foreign employee’s place of residence with the residence registration authorities. You must complete this process within 30 calendar days after receiving the temporary residence certificate.
Revocation of the temporary residence certificate
The temporary residence certificate can be revoked in the following cases, in accordance with Ukrainian legislation:
- Providing false information or using forged documents to obtain the temporary residence certificate.
- Termination of the activity that justified the issuance of the temporary certificate, such as termination of employment or education, etc.
- Initiation of a criminal investigation.
- If the actions of the foreigner threaten the safety of Ukrainian citizens, endangering their life, health, or posing a terrorist threat.
- If there is a court decision regarding the forced deportation of the foreigner.
