“Forced return” and “forced expulsion” are a system of administrative and legal measures aimed at forcing foreigners who are illegally in Ukraine to leave the territory of Ukraine against their will and desire.
The grounds for making a decision on the forced return and expulsion of foreigners to their country of origin or a third country are
- actions that violate the legislation of Ukraine on the legal status of foreigners and stateless persons;
- actions contrary to the interests of ensuring the national security of Ukraine or the protection of public order;
if it is necessary to protect the health, rights and legitimate interests of Ukrainian citizens; - detention of foreigners by the state border guard authorities within the controlled border areas during an attempt or after illegal crossing of the state border of Ukraine;
- failure of a foreigner to comply with a decision on forced return within the established time limit without valid reasons.
Forced return and expulsion is carried out by decision of the:
- The State Migration Service of Ukraine;
- The State Border Guard Service of Ukraine;
- The Security Service of Ukraine;
- National Police of Ukraine.
THE DECISION ON FORCED RETURN AND EXPULSION OF FOREIGNERS MAY BE ACCOMPANIED BY A BAN ON ENTRY TO UKRAINE FOR THREE, FIVE, TEN OR MORE YEARS
A ban on entry to Ukraine can be appealed within 30 days. This can be either an appeal to a higher government agency or to a court. While the appeal is pending, the decision remains in force. Only after the decision to ban entry to Ukraine is canceled can such a person come to Ukraine.
